Acceptance of Terms
By downloading, installing, or using the WizFlower AI app and related services, you agree to these Terms of Use. If you do not agree with any part of these Terms, you must not use the Service.
These Terms apply to all users of the Service, including visitors, registered users, and subscribers.
The Service
WizFlower AI provides AI-powered image enhancement and visual effects services through its mobile application. Our features include, but are not limited to, AI image processing, style transfer, and facial effects.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any such modifications, suspension, or discontinuation.
Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We process your data solely to provide and improve the Service. We do not sell your personal information. Uploaded photos and facial data are deleted immediately after processing. See our Privacy Policy for full details.
Subscriptions & Payments
Paid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. Subscription fees are charged to the payment method associated with your App Store (Apple) or Google Play account.
You can manage or cancel your subscription at any time through your device's account settings (Apple ID or Google account settings). Cancellation takes effect at the end of the current billing period. We do not process cancellations directly.
All fees are non-refundable except as required by applicable law or the refund policy of the respective app store (Apple App Store or Google Play Store). For refund requests, please contact the relevant app store directly.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. The following activities are strictly prohibited:
- Creating, uploading, sharing, or distributing illegal, defamatory, hateful, threatening, or violent content
- Infringing the intellectual property rights of any person or entity
- Using the Service for unauthorized commercial purposes or to compete with WizFlower AI
- Attempting to disrupt, damage, or interfere with the Service or its underlying infrastructure
- Reverse engineering, decompiling, or disassembling any part of the Service
- Using automated tools, bots, or scripts to access the Service without authorization
- Misrepresenting your identity or impersonating another person
Violations of these rules may result in immediate suspension or permanent termination of your access to the Service, without refund.
Intellectual Property
The Service, including all software, algorithms, designs, features, graphics, and underlying technology, is owned by WizFlower AI and its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial purposes, subject to these Terms. You may not sublicense, sell, or assign this license.
Your Content
You retain full ownership of all photos and content you upload to the Service ("Your Content"). By uploading content, you grant WizFlower AI a worldwide, royalty-free, non-exclusive license to use, process, store, and display Your Content solely for the purpose of providing the Service to you.
This license ends automatically when your content is deleted from our systems. For photos uploaded for AI processing, deletion occurs immediately after the effect is delivered. See our Data Retention Policy for details.
You represent and warrant that you own or have the necessary rights to upload Your Content, and that Your Content does not violate any third party's rights or applicable law.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED, ERROR-FREE OPERATION.
We do not warrant that the Service will meet your requirements, or that results obtained from using the Service will be accurate or reliable. You use the Service at your own risk.
Limitation of Liability
To the fullest extent permitted by applicable law, WizFlower AI, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, goodwill, or other intangible losses
- Damages arising from your use of or inability to use the Service
- Damages arising from any unauthorized access to or use of our servers or any personal data stored therein
In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability, our liability shall be limited to the maximum extent permitted by law.
General Provisions
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and updating the Effective Date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under or in connection with these Terms shall be subject to binding individual arbitration. You waive any right to participate in class action lawsuits or class-wide arbitration.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WizFlower AI regarding the Service and supersede all prior agreements relating to its subject matter.
